  • Notes:
  • Originally published in 1752, this book was carefully studied by our founding Fathers in crafting the Constitution. Montesquieu describes the types of laws that existed in various forms of governments and the freedoms enjoyed by each. He then examines the underlying "spirit" of the populous that makes each of these governments work. Finally, he discusses the conditions that must prevail to sustain each of these "spirits." Unlike his contemporary Rousseau, an ivory tower theorist, Montesquieu traveled extensively and lived in the various countries with their different forms of government. His conclusions are based, therefore, on empirically gathered data. His book is the most frequently cited work by the founding Fathers and by the authors of the Federalist papers. He cites the republican form of government as the freest, but which must be sustained by the spirit emanating from an educated populous. Other forms of government can be sustained by natural, base instincts or spirits existing within the populous such as fear or greed which require no education.
